Terms of Service

1. General provisions

1.1. These Terms and Conditions (the “Terms”) govern the use of the CardCanFly website, available at cardcanfly.com, and the provision of electronic services, including paid services.

1.2. These Terms constitute regulations for the provision of electronic services within the meaning of Article 8 of the Polish Act of 18 July 2002 on Providing Services by Electronic Means.

1.3. The Service enables users to create and send personalized physical and electronic cards. All orders are fulfilled according to the user’s individual instructions (including the use of base templates in the editor).

1.4. Use of the Service constitutes acceptance of these Terms.

2.4. The Service Provider conducts unregistered activity (działalność nierejestrowana) within the meaning of Article 5 of the Polish Act of 6 March 2018 — Entrepreneurs’ Law. Contact with the Service Provider takes place primarily electronically at the email address stated above.

2.5. NIP (Polish Tax ID): nie dotyczy

2.6. VAT status: The Seller benefits from a VAT exemption.

3. Definitions

3.1. E-card (electronic card) — digital content sent by email or provided as a unique viewing link.

3.2. Personalized product — a card made to the buyer’s individual instructions using their texts, images, or design.

3.3. Business day — Monday to Friday, excluding public holidays in Poland.

4. Age restrictions

4.1. The Service is intended for persons aged 16+. Persons under 16 may use the Service only with written consent of a parent or guardian.

4.2. Users aged 16–18 confirm their consent to make purchases within the Service.

4.3. The Service reserves the right to request age verification if needed.

5. Technical file requirements

5.1. Uploaded files must meet the following requirements:

  • Supported formats: JPG, JPEG, PNG, WEBP, SVG
  • Recommended file size up to 10 MB
  • Recommended image resolution: 300 DPI

5.2. The Service is not responsible for print quality if uploaded files do not meet the technical requirements.

6. Intellectual property and user content

6.1. The user is responsible for the text, images, and other materials they add to an order and must not use them unlawfully or in violation of third-party rights.

6.2. Private correspondence is not routinely reviewed. Clearly unlawful content, pornography, threats, incitement to violence, or hatred is prohibited.

6.3. The user grants the Service a non-exclusive license to use uploaded materials solely for technical processing, printing, and order fulfillment.

6.4. The Service may reject clearly prohibited content or act on a substantiated notice of infringement. Questions and notices can be sent to [email protected].

6.5. The user has the right to appeal if content is removed or an order is rejected.

7. Registration and user data

7.1. To fully use the Service, the user must register and provide the following required data:

  • First and last name
  • Email address
  • Password
  • Delivery and/or dispatch address

7.2. After registration, a confirmation with an activation link will be sent to the provided email. Registration is completed after following the link.

7.3. The user may change their data at any time in the account area and may delete their account themselves.

7.4. The Service reserves the right to verify the accuracy of the provided data and to block the account if fraud or a breach of the terms of use is suspected.

8. Description of services

8.1. The Service allows users to:

  • create and personalize cards online using images and texts provided by the Service or their own;
  • order printing and delivery of a physical card by post or courier, and duplicate the physical card with an electronic card (e-card);
  • send an electronic card (e-card) by email;
  • add a QR code to cards that opens a music track on Spotify when scanned.

8.2. All personalized orders are fulfilled manually or via print contractors. Physical cards are delivered by postal or courier services (e.g., Poczta Polska, InPost, DHL, etc.), and e-cards are delivered to the email specified by the buyer.

8.3. QR code with music track:

  • The list of available tracks is based on Spotify’s official catalog and may vary by region and service availability.
  • The user selects a track from the available list to add to the card.
  • The QR code leads to the track’s official page on Spotify (app or web).
  • Music playback on the site uses Spotify’s official embedded player (iframe/Embed). We do not store or transmit audio content; playback, licensing, and availability are provided by Spotify under its terms.
  • Listening may require the recipient to have a Spotify account and/or service availability in their country. Track availability, playback quality, and any restrictions are governed by Spotify and may change without our involvement.
  • The embedded Spotify player may set cookies or use similar third-party technologies. See Spotify’s Privacy Policy and our Cookie Policy for details.
  • We use only official Spotify widgets and links and do not provide standalone music playback outside Spotify services. All rights to recordings and trademarks belong to their respective owners.

9. Contract formation

9.1. Information on the website does not constitute an offer under civil law; it is an invitation to make an offer. By placing an order via the “Order and pay” interface, the User makes an offer to conclude a contract.

9.2. The contract between the User and the Seller is concluded when the payment operator confirms successful payment and the Service records that payment. A delayed or undelivered email notification does not affect contract formation or fulfillment of a paid order.

9.3. Before placing an order, the User confirms having read and agreed to the Terms and the Privacy Policy and acknowledges that the 14-day right of withdrawal does not apply to personalized products.

9.4. The order summary is available in the “Orders” section, and the current version of these Terms is available at all times on the “Terms of Service” page in the application.

10. Prices and payment

10.1. All prices are shown in the currency selected by the user and include all applicable fees. The Service is not a VAT payer. The user may change the payment currency at their discretion.

10.2. Payments are accepted via methods available in your region and provided by Stripe. Card data are not stored on our servers.

10.3. Upon request, the Service can provide proof of payment (e.g., a receipt from the payment operator or written confirmation by email).

10.4. Refunds are made using the same payment method used for the original payment.

11. Promo codes and discounts (Omnibus)

11.1. When discounts are applied, the Service shows the lowest price from the last 30 days as a reference point for users.

11.2. Promo codes applied to a submitted order cannot be revoked retroactively.

11.3. The Service provides users with free promo codes for discounts. Promo codes may be issued for various reasons, including but not limited to: compensation for claims (as a promo code), promotions, affiliate programs, holiday offers, and advertising campaigns.

11.4. Promo code usage rules:

  • Each promo code has its own conditions of use
  • Promo codes may require a minimum order value
  • Each promo code can be used only once
  • Promo codes are not exchangeable for cash
  • Promo codes do not combine with other discounts unless stated otherwise
  • Promo codes apply only to the product price and do not reduce shipping costs

11.5. The Service reserves the right to revoke or change promo code terms at any time without prior notice, set expiry dates, limit the number of promo codes available to one user, and refuse a code in case of suspected fraud.

11.6. Users acknowledge that promo codes may expire at any time without compensation; the Service is not responsible for loss of codes due to technical reasons; use of promo codes is a privilege, not a right; if the terms are breached, a promo code may be voided.

11.7. Discounts shown in the product price apply only during their validity period. If a user adds a discounted product to the cart but the discount is canceled or changed before checkout, the cart price will be recalculated to the current non-discounted price.

12. Ordering and fulfillment

12.1. An order is considered accepted after payment is confirmed. A physical or mixed order is then transferred directly to processing; a fully electronic order is completed and its electronic part becomes available. Any email confirmation is informational only, and its delay or non-delivery does not affect acceptance of the order.

12.2. Order processing time: for physical cards — production and dispatch occur within 24 hours after payment (approximate).

12.3. Delivery time depends on the selected postal/courier service and is shown at checkout.

12.4. E-cards are sent on the date specified by the user after payment. If an electronic delivery attempt fails for technical reasons, one automatic retry is made during the next delivery cycle. After a second failure, the delivery is held for manual review.

12.5. All timelines are approximate. The Service strives to meet them but does not guarantee punctuality due to external factors.

12.6. Before payment, the user approves the card layout in the preview. The user is responsible for typos, element placement, and content entered in the editor. Technological color deviations between screen and print within industry tolerances are possible.

12.7. For your convenience and security, the Service uses the following limits:

  • Cart holds up to 50 items — helps keep the site fast and avoid technical issues when processing orders
  • 90 days in the cart — cart items older than this are automatically removed; prices and availability are recalculated when the order is created
  • 7 days to pay unpaid orders — if an order is not paid within this period, it is automatically removed
  • Automatic cleanup — frees space for new orders and prevents confusion with old carts

12.8. Caring for your data and privacy:

  • Order materials: materials are stored while required for fulfillment, complaints, accounting, security, and other legal obligations. Completed or refunded orders and related images may be moved to archive storage no earlier than 90 days after the latest scheduled dispatch date;
  • E-cards: after sending, you receive a unique link to view the card. You can copy this link and share it with the recipient via any channel (WhatsApp, Telegram, SMS, etc.). Understanding the confidential nature of the information, you are responsible for the secure sharing of the link. The Service is not responsible for disclosure if the user shares the link with third parties;
  • Your control: you can request earlier deletion of your materials, subject to applicable contractual and legal retention obligations, by writing to [email protected].

13. Electronic materials and right of withdrawal

13.1. Electronic materials include personalized cards, invitations, photos, and other products supplied electronically.

13.2. Before payment, the user explicitly agrees that the electronic part will be made available after payment. It can then be sent at the selected time, sent immediately, or shared by a link generated by the user.

13.3. The selected recipient delivery time does not delay access for the buyer. Once access is provided, the electronic part can no longer be cancelled and the right of withdrawal is lost where permitted by applicable law.

13.4. An electronic delivery or shared link that has already been provided cannot be recalled. Technical delivery problems can be reported to [email protected].

13.5. A completed order is not retroactively cancelled. If the Service cannot provide all or part of the agreed service because of a defect, non-delivery, or another technical issue attributable to the Service, it may resolve the complaint by reworking, reprinting, resending, granting account credit, or issuing a full or proportionate refund. The order keeps its fulfillment history. Where relevant to the resolution, the Service may stop any remaining electronic delivery and access to order files.

14. Personalized orders and right of withdrawal

14.1. Under EU law (including Directive 2011/83/EU and the Polish Consumer Rights Act), the standard 14-day withdrawal period (for consumers) does not apply to personalized products made to the buyer’s specifications.

14.2. Personalized orders include cards, invitations, photos, and other products containing the user’s text, images, or design. An unpaid order can be removed from the Orders page.

14.3. To request a change or cancellation of a paid physical order, the user may contact the Service until the order is marked as completed. A paid physical order enters processing immediately, so the request does not guarantee that a change or cancellation is possible. The Service evaluates the actual production and dispatch stage and confirms any available remedy or refund.

14.4. If a personalized product is defective due to the Service, the user may choose: rework/reprint/refund.

15. Complaints and statutory warranty (rękojmia)

15.1. The user has the right to file a complaint in case of non-conformity with the contract or defects.

15.2. Complaints are submitted by email to [email protected] with the order number, problem description, and photos (if applicable).

15.3. The Service reviews complaints within 14 days of receipt.

15.4. If justified, the Service may offer: repair, reshipment, price reduction, or contract rescission.

15.5. These rights are governed by the Polish Civil Code.

16. Delivery and liability

16.1. Physical cards are delivered via third-party postal and courier services (Poczta Polska, InPost, DHL, etc.) to the delivery address provided by the user.

16.2. The Service is not liable for delays caused by postal operators. A tracking number is provided if available from the carrier and added to the order details once supplied.

16.3. In case of loss or damage during delivery, the user must contact the Service within 7 days from receipt or the expected delivery date.

16.4. For e-cards — if the message fails to arrive due to technical reasons attributable to the delivery service, the Service will resend the card or refund the payment.

16.5. When sending an e-card to someone else’s email, the user confirms the recipient’s consent to receive the e-card. Technical delivery failures are handled according to the retry and manual-review procedure described in section 12.4.

17. Privacy and processing of personal data (GDPR/RODO)

17.1. The Service is the controller of personal data under GDPR/RODO.

17.2. Data (name, delivery address, email, etc.) are used solely to fulfill the order and are not shared with third parties except necessary contractors (post, payment systems).

17.3. You have the right to request access, rectification, deletion, or restriction of processing by writing to [email protected].

17.4. Legal bases include: performance of a contract (Art. 6(1)(b) GDPR), legal obligations (Art. 6(1)(c)), and legitimate interests (Art. 6(1)(f)) for service security and abuse prevention. Data recipients: payment service provider (Stripe), postal and courier services, hosting providers, and other processors under contract.

17.5. You have the rights of access, rectification, deletion, restriction, objection, and data portability, and the right to lodge a complaint with the Polish DPA (UODO). Details in our Privacy Policy and Cookie Policy.

18. Liability and limitations

18.1. The Service is not liable for indirect damages or lost profits related to use of the Service.

18.2. The Service’s maximum liability is limited to the amount actually paid by the user for the order.

18.3. The service is provided “as is” — while we make every effort to deliver quality orders, we cannot guarantee uninterrupted website or postal service operation due to technical or legal reasons beyond our control.

19. Force majeure

19.1. The Service is not liable for failure or improper performance caused by force majeure, including but not limited to:

  • natural disasters (floods, earthquakes, hurricanes, etc.)
  • pandemics, epidemics, quarantine restrictions
  • warlike actions, terrorist acts, civil unrest
  • mass strikes, transport route blockades
  • failures of postal and courier services
  • government actions restricting operations
  • hacker attacks, cyberattacks, DDoS attacks on the Service’s servers
  • server, hosting, database, or software failures
  • issues with internet providers and network connectivity
  • failures of payment systems and banking operations

19.2. In the event of force majeure, the Service will make every effort to inform users of delays and minimize negative effects.

20. DSA (Digital Services Act)

20.1. Contact point for notices of illegal content: [email protected].

20.2. The Service applies user-content moderation principles in accordance with the DSA.

20.3. Handling of notices of illegal content follows the notice-and-takedown procedure described in Section 6.

20.4. Users have the right to appeal if content is removed or access to services is restricted.

21. Governing law and dispute resolution

21.1. These Terms are governed by the laws of the Republic of Poland and the European Union.

21.2. All disputes, claims, and disagreements are first to be resolved through direct negotiations. If no agreement is reached, disputes are handled as outlined below.

21.3. Consumers may use out-of-court consumer dispute resolution (ADR). Information about competent Polish ADR entities is available from UOKiK: https://polubowne.uokik.gov.pl/. Use of ADR does not limit the right to go to court.

21.4. The Service Provider’s unregistered activity status does not limit any mandatory consumer rights.

22. Changes to the Terms

22.1. The Service reserves the right to amend these Terms at any time.

22.2. Users will be notified of changes by email or via a site banner 14 days before they take effect.

22.3. Orders placed before the changes take effect are fulfilled under the previous terms.
